 Your rights

Under the General Data Protection Regulation, you have the right to access, rectify, port and delete your data. Learn more about these rights and find out how you can exercise your rights here

The GDPR provides the following rights for individuals:
  1. The right to be informed
  2. The right of access
  3. The right to rectification
  4. The right to erasure
  5. The right to restrict processing
  6. The right to data portability
  7. The right to object
  8. Rights in relation to automated decision making and profiling.

You may exercise your rights in writing to us at info@wanderlustcamperco.com or by writing to 2 Dowles Cottages, Dymock, Gloucestershire, GL18 2AF.

What is the right of access? The right of access, commonly referred to as subject access, gives individuals the right to obtain a copy of their personal data as well as other supplementary information. It helps individuals to understand how and why you are using their data, and check you are doing it lawfully.

What is an individual entitled to?                    Individuals have the right to obtain the following from us - please request in writing:
  • confirmation that you are processing their personal data;
  • a copy of their personal data; and
  • other supplementary information – this largely corresponds to the information that you should provide in a privacy notice (see ‘Supplementary information’ below).

What is the right to data portability? The right to data portability gives individuals the right to receive personal data they have provided to a controller in a structured, commonly used and machine readable format. It also gives them the right to request that a controller transmits this data directly to another controller.

When does the right apply? The right to data portability only applies when:
  • your lawful basis for processing this information is consent or for the performance of a contract; and
  • you are carrying out the processing by automated means (ie excluding paper files).

What is the right to erasure? Under Article 17 of the GDPR individuals have the right to have personal data erased. This is also known as the ‘right to be forgotten’. The right is not absolute and only applies in certain circumstances.
When does the right to erasure apply?
Individuals have the right to have their personal data erased if:

  • the personal data is no longer necessary for the purpose which you originally collected or processed it for;
  • you are relying on consent as your lawful basis for holding the data, and the individual withdraws their consent;
  • you are relying on legitimate interests as your basis for processing, the individual objects to the processing of their data, and there is no overriding legitimate interest to continue this processing;
  • you are processing the personal data for direct marketing purposes and the individual objects to that processing;
  • you have processed the personal data unlawfully (ie in breach of the lawfulness requirement of the 1st principle);
  • you have to do it to comply with a legal obligation; or
  • you have processed the personal data to offer information society services to a child.

What is the right to object?Article 21 of the GDPR gives individuals the right to object to the processing of their personal data. This effectively allows individuals to ask you to stop processing their personal data.
The right to object only applies in certain circumstances. Whether it applies depends on your purposes for processing and your lawful basis for processing. Read more here.
This is a summary of your rights - full details can be found here

Reporting a concern:
If you have a concern about an organisation's information rights practices you can read more here or call the ICO helpline on 0303 123 1113.

Data Retention, account deactivation and deletion

We store data until it is no longer necessary to provide our services or until your account is deleted – whichever comes first. This is a case-by-case determination that depends on things such as the nature of the data, whether an insurance claim has been made, if there has been legal intervention or a crime has been committed, such as speeding offence.  Please view our data policy for more information on the data we require for us to undertake offering our campervans to hire for you as we are obliged to retain certain information for a specific time period.
